Terms & Conditions of Carriage

MJ-Marchington Logistics

1. Definitions

  • Carrier: MJ-Marchington Logistics
  • Customer: The person or company booking the service
  • Goods: Items being transported
  • Consignment: A single delivery from one address to another
  • Consignor: Person sending the goods
  • Consignee: Person receiving the goods
  • Dangerous Goods: Items that pose risk (e.g. hazardous materials, explosives)
  • Loss: Failure to deliver or damage to goods
  • Owner’s Risk: Goods carried without liability to the carrier


2. Contract & Responsibilities


  • By booking, you agree to these terms.
  • The customer must have authority over the goods.
  • We may use subcontractors where necessary.
  • Dangerous goods require prior written approval.


3. Loading & Unloading


  • The customer is responsible for loading and unloading unless agreed otherwise.
  • If our driver assists, they act under your instruction.
  • We are not liable for:
  • Improper loading
  • Faulty equipment provided by customer
  • Instructions given by customer


4. Dangerous Goods

  • Must be declared in writing before transport.
  • Must be correctly packaged and labelled.
  • Customer is fully liable for any issues caused by non-compliance.


5. Proof of Delivery

  • We can provide:
  • Collection confirmation
  • Delivery signature (proof of delivery)
  • These do not confirm condition or value of goods.


6. Liability & Responsibility

  • Responsibility starts when we collect the goods.
  • Responsibility ends when delivery is completed or attempted.
  • Goods may be held at Owner’s Risk if agreed.


7. Charges & Payment

  • Payment terms are agreed before the job.
  • If not specified: payment due within 30 days.
  • Late payments may incur interest (8% above Bank of England base rate).
  • Charges must be paid regardless of disputes.


8. Undeliverable Goods

If delivery cannot be completed:

  • We will contact you for instructions.
  • Additional storage or handling charges may apply.
  • If no response:
  • Goods may be stored, returned, or sold (where legally permitted).


9. Liability for Loss or Damage

We are liable only if loss/damage is caused by our negligence.

We are not liable for:

  • Acts of God (weather, disasters)
  • War, terrorism, or government action
  • Poor packaging or labelling
  • Incorrect information provided
  • Natural deterioration of goods
  • Strikes or delays beyond control


10. Compensation Limits

Unless agreed otherwise:

  • £1,300 per tonne OR
  • £500 per consignment (whichever is higher)
  • Never exceeding actual value of goods

We strongly recommend insurance for high-value items.

11. Customer Responsibilities

You agree to cover costs or claims resulting from:

  • Incorrect information
  • Improper packaging
  • Dangerous goods violations
  • Third-party claims beyond our liability limits


12. Claims Procedure

To make a claim:

  • Full loss: notify within 14 days
  • Partial damage: notify within 7 days
  • Delay: notify within 3 days


All claims must include:

  • Description
  • Value
  • Dates

Claims expire after 1 year.

13. Right to Hold Goods (Lien)

  • We may retain goods until all charges are paid.
  • If unpaid, goods may be sold to recover costs.

14. Vehicle Detention

  • Extra charges apply if vehicles are delayed excessively during loading/unloading.

15. Dispute Resolution

  • We aim to resolve disputes amicably.
  • If unresolved, mediation may be used.
  • Legal proceedings are a last resort.


16. Confidentiality

  • Both parties agree to keep business information confidential.

17. Governing Law

These terms are governed by English law.

  • Reading and understanding these terms
  • Ensuring goods are properly insured during transit
